I am currently the sole parent of a 17 y/o transgender male who is requesting testosterone (T) treatment. He has been seeing a child psychologist and gender health specialist (Endocrinologist) for almost a year and is ready for this next step. Unfortunately, the clinic is unable to move forward with T without consent from BOTH biological parents, regardless of their relationship (divorced, never married, etc). My child’s estranged father is adamant about not releasing consent and would rather our child wait until he’s 18 to start treatment so I am forced to move forward legally with requesting sole medical decision-making authority.
Traversing the legal system is frustrating at best and since we were never married nor had a parenting plan, I’m at a loss of where to start. We had a legal representative draw up and notarize a special (medical) power of attorney but it won’t satisfy the state’s requirement. Has anyone pursued this route before? And if so, what exactly did you petition the court for? Did you use a DIY Kit or hire a lawyer?
